Program Objectives

The new requirements as of November 1, 2018 will impose notice requirements in the event of a “breach of security safeguards” on all organizations regulated by the Personal Information Protection and Electronic Documents Act (“PIPEDA”), and corresponding new record-keeping requirements.

The new regulatory requirements set out a mandatory breach notification framework which contain a three-pronged notice requirement: Report to the Office of the Privacy Commissioner of Canada; Notice to affected individuals; and Notice to other organizations.

Participants will:

  • Understand the new mandatory breach notification framework and its corresponding requirements
  • Understand the first party and third party liability risks created by the new breach notification framework
  • Explore insurance and risk management solutions to the compliance, first party and third party risks associated with the new privacy/security notification regime.
